TERMS OF SERVICE

1. ABOUT US
This website, dangl.com.au, is operated by Dangl ("Dangl", "we", "us", "our"), an Australian business based at 97 Parsons Road, Forest Glen QLD 4556, on the Sunshine Coast, Queensland.
By visiting our website or purchasing from us, you agree to these Terms of Service. Please read them carefully. If you do not agree, please do not use this website.

2. ELIGIBILITY
You must be at least 18 years old, or have the consent of a parent or guardian, to place an order. By ordering, you confirm that the information you provide is accurate and complete.

3. PRODUCTS
We make every effort to display our products accurately, including colours, dimensions and specifications. Colours may appear slightly different depending on your screen, and minor variations can occur between production batches.
All specifications, including the 150kg weight rating, 3m x 2.2m dimensions and packed weight, are provided in good faith and based on our product testing.
We reserve the right to change product designs, specifications or availability at any time without notice.

4. SAFE USE
Our hammocks must be used in line with the instructions provided. You are responsible for:
- Hanging the hammock only from strong, healthy, secure anchor points that can safely hold the load
- Never exceeding the 150kg weight rating
- Inspecting the hammock, straps and carabiners for wear or damage before every use
- Hanging the hammock at a safe height, over a safe surface
- Supervising children at all times while they use or are near the hammock
- Complying with the rules of any park, campsite or property where you hang the hammock
Do not stand, jump or swing aggressively in the hammock. Do not use it for climbing, lifting or any purpose other than resting and relaxing.

5. PRICING
All prices are in Australian dollars (AUD) and include GST where applicable.
We reserve the right to change prices at any time. The price charged is the price shown at the time you place your order.
If a product is listed at an incorrect price due to a typographical or system error, we may cancel any order placed at that price and refund you in full, even after the order has been confirmed.

6. PROMOTIONS AND DISCOUNT CODES
Promotions and discount codes are valid only for the period stated and cannot be combined unless we say otherwise. Discount codes have no cash value, cannot be applied to past orders, and may be withdrawn or changed at any time. We may cancel orders that misuse promotions.

7. ORDERS AND PAYMENT
Placing an order is an offer to buy. A contract forms when we dispatch your order. We may refuse or cancel any order, including where a product is out of stock, a pricing error has occurred, or we suspect fraud. If we cancel an order after payment, we will refund you in full.
Payment is processed securely through Shopify and our payment providers. We do not store your full card details.

8. SHIPPING
We currently ship within Australia only.
Orders are dispatched within 1 to 2 business days. Delivery times after dispatch depend on the carrier and your location, and are estimates, not guarantees.
Free standard shipping applies to orders over $99 AUD. Orders under $99 are charged the shipping rate shown at checkout.
Please make sure your delivery address is correct. We are not responsible for orders delivered to an incorrect address provided by you.
Risk in the products passes to you on delivery.

9. RETURNS AND REFUNDS
Returns and refunds are handled under our Refund Policy, which forms part of these Terms.

10. AUSTRALIAN CONSUMER LAW
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law.

11. LIMITATION OF LIABILITY
To the maximum extent permitted by law, and subject to your rights under the Australian Consumer Law:
- We are not liable for any loss, injury or damage caused by use of our products contrary to our instructions or the Safe Use section above, including use beyond the weight rating or from unsuitable anchor points
- We are not liable for indirect or consequential loss
- Where our liability cannot be excluded but can be limited, it is limited to replacing the goods, supplying equivalent goods, or refunding the price you paid

12. INTELLECTUAL PROPERTY
All content on this website, including the Dangl name and logo, text, images, photography, videos and designs, belongs to Dangl or our licensors. You may not copy, reproduce or use any of it for commercial purposes without our written permission.

13. REVIEWS AND USER CONTENT
If you submit a review, photo, comment or other content, you confirm it is your own, honest and lawful, and you give us a free, non-exclusive, perpetual licence to use, display and share it in connection with Dangl, including on our website and social media. We may remove any content at our discretion.

14. ACCEPTABLE USE
You must not use this website to commit fraud, interfere with its operation, attempt to gain unauthorised access, introduce malicious code, or breach any law.

15. THIRD-PARTY LINKS
Our website may link to third-party websites. We are not responsible for their content, products or privacy practices.

16. PRIVACY
Your personal information is handled under our Privacy Policy.

17. CHANGES TO THESE TERMS
We may update these Terms at any time by posting the updated version on this page. The Terms in place when you place an order apply to that order.

18. GOVERNING LAW
These Terms are governed by the laws of Queensland, Australia. You agree to the non-exclusive jurisdiction of the courts of Queensland.
